Terms of Service

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this age requirement.

You are responsible for maintaining the security of your account and password. FieldTap cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

• You must provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• One person or legal entity may not maintain more than one free account.
• You may not use the Service for any illegal or unauthorized purpose.

You agree not to:

• Use the Service in violation of any applicable law or regulation
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit viruses, malware, or any other malicious code
• Use the Service to store or transmit content that infringes on intellectual property rights of others
• Resell, sublicense, or provide the Service to third parties without our written consent
• Scrape, data-mine, or otherwise extract data from the Service using automated means
• Use the Service to collect or store sensitive personal information of others without proper authorization and consent

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of BID Partners LLC. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

The FieldTap name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BID Partners LLC. You must not use such marks without our prior written permission.

You retain full ownership of all field data, photographs, records, and any other content you create or upload through the Service ("Your Data").

We do not claim any ownership rights over Your Data. By using the Service, you grant us a limited license to host, store, transmit, and display Your Data solely for the purpose of providing and improving the Service.

You may export Your Data at any time using the export features available in the Service. Upon termination of your account, we will make Your Data available for export for a period of 30 days, after which it may be deleted.

We will not access, use, or share Your Data except as necessary to provide the Service, comply with the law, or as otherwise described in our Privacy Policy. We will never sell Your Data to third parties.

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.

The offline functionality of the Service is designed to allow continued data collection when an internet connection is unavailable. Data will sync automatically when connectivity is restored. However, we cannot guarantee the offline functionality will work in all circumstances or on all devices.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIELDNOTE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You may terminate your account at any time by contacting us or using the account deletion feature in the Service. Upon termination, your right to use the Service will immediately cease.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, we will provide you with 30 days to export Your Data, unless the termination is due to a violation of these Terms involving illegal activity.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to the personal jurisdiction of such courts.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service and contact us to delete your account.
